These Terms of Service ("Terms") govern your use of the DROMOS mobile application and website (the "Service"), operated by Justin Phillips ("we," "us," or "our"). By using the Service, you agree to these Terms.
DROMOS is a personal race passport application for tracking running race history. You may use the Service for personal, non-commercial purposes only. You agree not to:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at getdromos@gmail.com.
You must be at least 13 years of age to use the Service.
You retain ownership of all content you submit to the Service, including race data, photos, and profile information ("Your Content"). By submitting Your Content, you grant DROMOS a non-exclusive, worldwide, royalty-free license to store, display, and process Your Content solely to provide the Service to you.
You represent that you have the right to submit Your Content and that it does not infringe on any third-party rights.
The Service may integrate with third-party platforms such as RunSignUp. Your use of those integrations is also subject to those platforms' terms of service. DROMOS is not responsible for the content, accuracy, or availability of third-party platforms.
DROMOS includes community features that allow users to follow each other, view race results, and react to races. By making your profile public, you agree that other DROMOS users may view your race history, handle, and profile photo. You can switch your profile to private at any time in Settings.
The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
GPS tracking accuracy depends on device hardware and environmental conditions. DROMOS does not guarantee the accuracy of GPS distance or pace measurements.
To the maximum extent permitted by law, DROMOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
You may delete your account at any time from the Settings tab in the app. Upon deletion, your account data and race history will be permanently removed from our systems.
We reserve the right to suspend or terminate accounts that violate these Terms.
We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions.
